Terms of Use
1. About these terms
1.1 These terms are an agreement between you and Pocket Apps Studio Pte. Ltd. (UEN 202549990M), 160 Robinson Road, #14-04 Singapore Business Federation Center, Singapore 068914 (“we”, “us”), the maker of the XueTang app.
1.2 By downloading or using XueTang you agree to these terms. If you do not agree, please do not use the app.
1.3 How we handle your personal data is explained in our Privacy Policy.
2. The app
2.1 XueTang helps you learn Mandarin Chinese. It teaches vocabulary and grammar from the HSK 3.0 syllabus along a guided path of units and lessons, schedules your reviews with the FSRS spaced-repetition algorithm, scores your tones on your device, and lets you add and practise your own words.
2.2 XueTang is a learning aid. We work hard to make its content accurate, but we do not promise that it is free of errors or that using it will lead to a particular result, such as passing an HSK exam.
2.3 Lessons and reviews work offline. Signing in, syncing your progress, buying a subscription and sending feedback need an internet connection.
2.4 We keep improving XueTang and may add, change or remove features and content. Some changes need an app update. If you do not install updates, parts of the app may stop working correctly.
3. Your account
3.1 You can try the app and finish your first lesson without an account. To continue, you sign in with Apple or Google, which creates your XueTang account.
3.2 You must be at least 13 years old to use XueTang. If you are under 18, or under the age of majority where you live, you may only use it with the permission of a parent or guardian.
3.3 Your account is personal to you. Keep access to your Apple or Google account secure. Tell us at support@pocketapps.studio if you think someone else is using your XueTang account.
3.4 You can delete your account at any time in the app (Settings → Profile → Delete Account). This permanently deletes your progress and the words you added. It does not cancel a subscription (see section 5.4).
4. Free and Premium
4.1 XueTang is free to download. The free version includes part of the course and the core learning features. Premium unlocks the rest of the content and features. What is included in each is shown in the app.
4.2 We may change what the free version includes. We will not reduce what Premium includes in a way that materially lowers its value during a period you have already paid for. If we do, you may cancel and ask Apple for a refund for the rest of that period.
5. Subscriptions
5.1 Premium is an auto-renewing subscription bought through the Apple App Store. The available plans, prices and billing periods are shown in the app before you buy. Payment is taken by Apple from your Apple Account. Apple’s Media Services Terms and Conditions also apply.
5.2 Free trial. Some plans include a free trial, shown in the app before you buy. Unless you cancel at least 24 hours before the trial ends, your subscription starts and you are charged automatically when the trial ends.
5.3 Renewal. Your subscription renews automatically at the end of each billing period at the price then in effect, unless you cancel at least 24 hours before the period ends. If the price changes, Apple will tell you in advance and, where required, ask for your consent.
5.4 Cancelling. Cancel in your Apple Account settings (Settings → your name → Subscriptions). Deleting the app or your XueTang account does not cancel your subscription. After you cancel, Premium stays active until the end of the period you have paid for, and then the app returns to the free version.
6. Refunds
6.1 Apple processes all payments and refunds. We cannot issue refunds ourselves. You can request a refund from Apple at reportaproblem.apple.com.
6.2 Nothing in these terms affects your rights under the Consumer Protection (Fair Trading) Act 2003 or any other consumer law that applies to you and cannot be excluded.
6.3 Consumers in the EU, EEA and UK. You buy Premium from Apple, not from us. Your right to withdraw from the purchase within 14 days, when that right ends once you ask for immediate access, and how to use it are set out in Apple’s Media Services Terms and handled by Apple, for example at reportaproblem.apple.com. Nothing in these terms limits any right of withdrawal you have by law.
7. Using XueTang fairly
7.1 XueTang is for your own personal, non-commercial learning. You may not use it to provide services to others or for any commercial purpose without our written permission.
7.2 You must not:
- copy, sell, share or publish the app’s content, such as word lists, example sentences, audio, illustrations or lessons, outside the app,
- copy, modify or reverse engineer the app, except as far as the Copyright Act 2021 or other law expressly allows,
- extract the app’s content with automated tools,
- interfere with the app, its servers or other people’s use of it, or try to access data that is not yours,
- use the app in a way that breaks the law.
7.3 If you break these rules, we may suspend or close your account (see section 11).
8. Your content
8.1 The words, meanings and example sentences you add stay yours. You give us permission to store and process them only to provide the app to you, for example to schedule your reviews and sync them to your devices.
8.2 You are responsible for what you add and must have the right to use it.
8.3 If you send us feedback or ideas, we may use them to improve XueTang without paying you or owing you anything. We will not publish your name with them without asking you.
9. Our content
9.1 The app and its content, including the course, word lists, example sentences, grammar explanations, audio, illustrations, characters and design, belong to us or our licensors and are protected by copyright and other laws.
9.2 We give you a personal, non-exclusive, non-transferable licence to use XueTang on Apple devices you own or control, as allowed by the App Store terms, for as long as you follow these terms. We keep all rights we do not expressly give you.
10. Liability
10.1 We provide XueTang with reasonable care and skill. We do not guarantee that it will always be available, uninterrupted or error-free. This does not affect your statutory rights.
10.2 We are not responsible for losses that are not a foreseeable result of our breach of these terms, or for indirect or consequential losses, such as lost profits or lost opportunities.
10.3 If you live outside the EU, EEA and UK, our total liability to you under or in connection with these terms is limited to the greater of (a) the amount you paid for XueTang in the 12 months before the event giving rise to the claim, and (b) SGD 50.
10.4 Sections 10.2 and 10.3 do not apply to liability for death or personal injury caused by our negligence, for intent or gross negligence, for fraud, or under mandatory product liability law.
10.5 If you live in the EU, EEA or UK, sections 10.2 and 10.3 do not apply. Our liability follows the statutory rules of your country, and your statutory rights, including for faulty digital content or services, are not affected.
11. Ending this agreement
11.1 You can stop using XueTang at any time and delete your account in the app.
11.2 We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires us to. Where we reasonably can, we will warn you first and give you a chance to fix the problem. If we close your account without a good reason under these terms while you have a paid subscription, you may ask Apple for a refund for the unused period.
11.3 If we ever stop offering XueTang, we will give you reasonable notice in the app.
11.4 Sections 8.3, 9, 10, 13 and 15 continue to apply after this agreement ends.
12. Changes to these terms
We may update these terms, for example when we add features or when the law changes. We will update the date below. If a change materially affects you, we will tell you in the app or by e-mail before it takes effect. If you do not agree with a change, you can stop using XueTang, cancel your subscription and delete your account.
13. Apple App Store terms
13.1 These terms are between you and us, not Apple. We, not Apple, are responsible for XueTang and its content.
13.2 Apple has no obligation to provide maintenance or support for XueTang.
13.3 If XueTang fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
13.4 We, not Apple, are responsible for handling any claims relating to XueTang, including product liability claims, claims that the app does not meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
13.5 If a third party claims that XueTang or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
13.6 You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
13.7 You must also follow any third-party terms that apply when you use XueTang, such as the terms of your mobile network.
13.8 Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Contact
For questions about XueTang or these terms, write to support@pocketapps.studio. Formal legal notices go to Pocket Apps Studio Pte. Ltd., 160 Robinson Road, #14-04 Singapore Business Federation Center, Singapore 068914.
15. Law and disputes
15.1 These terms are governed by the laws of Singapore.
15.2 If you have a problem, please contact us first at support@pocketapps.studio. Most issues can be solved quickly that way.
15.3 If we cannot resolve it, the courts of Singapore have jurisdiction. Consumers in Singapore may also bring a claim before the Small Claims Tribunals where it is eligible.
15.4 If you are a consumer living outside Singapore, you also keep the protection of the mandatory consumer laws of your country, and you may bring a claim in the courts of your country where its law allows.
16. General
16.1 These terms, together with the Privacy Policy and the plan details shown to you when you buy, are the whole agreement between you and us about XueTang.
16.2 If a court decides that part of these terms cannot be enforced, the rest stays in force.
16.3 If we do not enforce a right immediately, we can still enforce it later.
16.4 We may transfer this agreement to another company that takes over XueTang, provided your rights are not reduced. You may not transfer it without our consent.
16.5 Apart from Apple under section 13.8, no one else has a right to enforce these terms under the Contracts (Rights of Third Parties) Act 2001.
16.6 These terms are written in English. If we provide a translation, the English version applies in case of any difference.
16.7 These terms are always available in the app and at https://xuetang.app/terms.
